By accessing or using My Realty Mate (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including registered account holders and any person who accesses the Service.

2. Description of Service

My Realty Mate is a real estate transaction management platform that provides tools for managing transactions, workflows, tasks, emails, contacts, documents, and communications related to real estate operations. The Service may integrate with third-party services including Google Workspace (Gmail, Calendar, Drive) to enhance functionality.

3. Account Registration and Security

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • You are responsible for all activities that occur under your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Upload or transmit viruses, malware, or any harmful code.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Interfere with or disrupt the Service or servers connected to it.
  • Scrape, data mine, or use automated tools to extract data from the Service without permission.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Use the Service to send spam or unsolicited communications.
  • Sublicense, resell, or redistribute the Service without prior written consent.

5. Third-Party Integrations

The Service integrates with third-party services, including Google APIs. By connecting your Google account, you authorize the Service to access data as described in our Privacy Policy. Your use of third-party services is also subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

6. User Data and Content

  • Ownership: You retain ownership of all data and content you upload or create on the Service ("User Content").
  • License: You grant us a limited, non-exclusive license to use, store, process, and display your User Content solely for the purpose of providing the Service.
  • Responsibility: You are solely responsible for your User Content and ensuring you have the right to upload and share it through the Service.
  • Backup: While we take reasonable measures to protect your data, you are responsible for maintaining your own backups of important data.

The Service, including its design, code, features, logos, and documentation, is the intellectual property of My Realty Mate and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

8. Service Availability and Modifications

  • We strive to provide uninterrupted access to the Service, but we do not guarantee 100% availability.
  • We may modify, suspend, or discontinue any feature of the Service at any time with or without notice.
  • Scheduled maintenance windows will be communicated in advance when possible.
  • We are not liable for any downtime or service interruptions.

9. Fees and Payment

Certain features of the Service may require payment. All fees are stated at the time of purchase and are non-refundable unless otherwise specified. We reserve the right to change pricing with reasonable advance notice. Continued use of paid features after a price change constitutes acceptance of the new pricing.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY REALTY MATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless My Realty Mate from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time by contacting us. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitations of liability) shall survive.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Florida.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
